1. Welcome to KwikResume. By accessing, browsing, or using our website (kwikresume.io) and associated services, applications, and tools, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").
2. KwikResume is a proprietary product developed, owned, and operated by LiFet Media Inc., a corporation based in Cornwall, Ontario, Canada. These Terms constitute a legally binding agreement between you and LiFet Media Inc. If you do not agree to these Terms in their entirety, you must immediately cease use of our website and services.
3. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

1. KwikResume provides advanced AI-powered resume building, formatting, and optimization tools designed to assist users in creating highly professional documents for job applications globally. Our comprehensive suite of services includes, but is not limited to:
   1. Global Formatting: Dynamic formatting according to the specific regional and cultural standards of over 60 countries.
   2. AI Generation: Cover letter and cold email generation tailored to specific job descriptions.
   3. ATS Optimization: Applicant Tracking System (ATS) scoring, and automated improvement suggestions.
   4. Voice-to-Text: Multilingual voice-to-resume generation capabilities for faster input.
2. We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice, without liability to you or any third party.

1. To utilize the full capabilities of KwikResume, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to continually update such information to keep it accurate.
2. You are entirely responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security, unauthorized use of your account, or any other security vulnerability. LiFet Media Inc. cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.
3. Accounts registered by "bots" or other automated methods are not permitted and will be immediately terminated without notice or refund.

You agree not to use the service for any illegal, unethical, or unauthorized purpose. By using KwikResume, you explicitly agree that you will not:

1. Falsify Information: Provide false, misleading, or fraudulent information on your resumes with the intent to deceive employers.
2. Interfere with the Service: Attempt to reverse engineer, decompile, hack, disable, interfere with, disassemble, modify, copy, translate, or disrupt the features, functionality, integrity, or performance of the Service.
3. Automated Access: Use automated scripts, bots, spiders, or scrapers to access, copy, or manipulate the service.
4. Malicious Code: Upload any material that contains software viruses, worms, Trojan horses, or any other computer code designed to interrupt, destroy, or limit the functionality of the platform.
5. Commercial Exploitation: Resell, sublicense, or distribute the AI-generated outputs commercially as a resume-writing service without explicit written consent from LiFet Media Inc.

1. Certain aspects of the Service are provided for a fee, subscription, or one-time payment. By choosing to purchase a paid plan, lifetime access pass, or credit pack, you agree to the pricing, payment terms, and billing cycles presented to you at the time of purchase.

2. Subscription Cancellations: If you are on a recurring monthly subscription, you have full control to cancel at any time through your account dashboard. Cancellation will immediately prevent any future billing, but no prorated refunds will be provided for the remainder of the current billing cycle. You will retain full access to the paid features until the end of your current paid period.
3. Credit Expiration: Purchased credit packs do not expire as long as your account remains active. However, if your account is terminated for violating these Terms, all remaining credits will be forfeited without compensation.

1. Platform Ownership: The Service and its original content, features, functionality, algorithms, design systems, and country-specific formatting templates are and will remain the exclusive property of LiFet Media Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of Canada and foreign countries.
2. User Input Data: You retain all ownership rights to the personal and professional data (User Content) you input into the system.

1. Your data is stored on Supabase-managed cloud infrastructure located in the United States West region Oregon. While LiFet Media Inc. is incorporated in Canada, user data is processed and stored on US-based servers.
2. By using KwikResume you consent to your data being transferred to and processed in the United States.

1. Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
2. LiFet Media Inc. does not warrant that:
   1. The Service will function uninterrupted, secure, or available at any particular time or location.
   2. Any errors or defects in the software will be corrected immediately.
   3. The Service is free of viruses or other harmful components.
   4. The results of using the Service will meet your specific requirements.

1. You agree to defend, indemnify, and hold harmless LiFet Media Inc., its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

1. Your use and access of the Service, by you or any person using your account and password.
2. A breach of these Terms.
3. Any claim that your User Content caused damage to a third party (e.g., providing falsified credentials to an employer).

1. To the maximum extent permitted by applicable law, LiFet Media Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the service.
2. In no event shall our total liability to you for all claims exceed the amount you paid to LiFet Media Inc. in the twelve months preceding the claim.

1. LiFet Media Inc. respects intellectual property rights and expects users to do the same. If you believe that content available through KwikResume infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent at: hello@kwikresume.io with the subject line DMCA Takedown Notice.
2. Your notice must include:
   1. Identification of the copyrighted work claimed to be infringed.
   2. Identification of the material claimed to be infringing and its location.
   3. Your contact information.
   4. A statement that you have a good faith belief that the use is not authorized.
   5. A statement under penalty of perjury that the information is accurate.
3. We will respond to valid takedown notices within 24 hours. Repeat infringers will have their accounts terminated.

1. These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
3. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
4. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Participation in the KwikResume.io referral program is subject to the following terms:

Eligibility and Credits

1. Each referral credit event is limited to one occurrence per new user account created.
2. A referral code may not be used by the person who owns that code to benefit themselves.
3. Credits are granted only upon successful completion of account registration by a new user using a valid referral link.
4. Clicking a referral link without completing signup does not trigger any credit.
5. Both the referring user and the newly registered user receive 100 credits upon successful referral conversion.
6. Credits earned through referrals have no cash value, cannot be transferred between accounts, and cannot be redeemed for money.

Social Share Credits

1. Users may earn 10 credits per social media platform by sharing KwikResume.io content on supported platforms.
2. Credits are granted on a trust-based system following user confirmation of sharing.
3. Credits are limited to one claim per platform per account, for the lifetime of the account.
4. Claiming credits by confirming a share without actually publishing the content constitutes fraud and may result in account suspension without notice.

Video Testimonial Credits and Marketing License

1. Users may earn 150 credits by submitting an approved video testimonial through the KwikResume.io platform.
2. Submission does not guarantee approval or credit. LiFet Media Inc. reserves the right to approve or decline any submission at its sole discretion without providing a reason.
3. By submitting a video testimonial you confirm and agree to all of the following:
   1. You are the person appearing in the video and the content accurately reflects your genuine experience with KwikResume.io.
   2. The content is truthful, voluntary, and does not contain any false, misleading, or defamatory statements.
   3. You are at least 18 years of age or have obtained parental or guardian consent.
   4. You grant LiFet Media Inc. and its successors, assigns, and licensees a perpetual, irrevocable, worldwide, royalty-free, fully paid-up license to use, reproduce, distribute, display, publish, broadcast, edit, modify, translate, create derivative works from, and otherwise exploit your video testimonial in any and all media formats and channels now known or hereafter developed, including but not limited to websites, social media platforms, paid advertising campaigns, email marketing, video platforms, print materials, trade shows, and any other promotional or marketing purposes.
   5. This license is granted without any obligation on the part of LiFet Media Inc. to compensate you in any form beyond the credit reward described above, and you expressly waive any right to additional compensation, royalties, or payments of any kind for any use of your testimonial.
   6. LiFet Media Inc. may use your first name, last initial, general location, and occupation alongside your testimonial without further consent.
   7. You may request removal of your testimonial from active marketing use by contacting hello@kwikresume.io. Upon a valid removal request LiFet Media Inc. will make reasonable efforts to remove the testimonial from future use within 30 days. However this does not affect any use that occurred prior to the removal request, and materials already distributed or published may remain in circulation.
   8. Credits are applied automatically to your account upon admin approval of your submission.
   9. When you check the consent checkbox and submit your video, KwikResume.io records the following information as a legally binding consent event: your user account identifier, the exact text of the agreement you accepted, your IP address, your device type, your browser and operating system, your screen resolution, your timezone, your preferred language, the URL of the page where consent was given, and the exact timestamp of consent. This record is stored securely and may be used as evidence of your agreement in any legal dispute.
4. LiFet Media Inc. is not liable for any claims arising from the content of submitted testimonials including claims by third parties. You indemnify and hold harmless LiFet Media Inc. from any and all claims, damages, or expenses arising from your testimonial submission.

The following activities are strictly prohibited and will result in immediate permanent account termination without refund:

1. Creating multiple accounts using different email addresses from the same device or IP address for the purpose of claiming referral credits.
2. Using virtual private networks (VPNs), proxy servers, or any IP-masking technology to circumvent our IP-based fraud detection systems with the intent to abuse the referral program.
3. Using automated scripts, bots, or programmatic methods to generate fake referral signups.
4. Sharing referral codes on platforms or communities in ways designed to generate mass signups from users who have no genuine interest in KwikResume.io.
5. Purchasing, selling, or trading referral codes or referral credits.
6. Creating fake social media posts or screenshots to claim social sharing credits.
7. Submitting video testimonials that contain false statements, impersonate another person, or are not genuine reflections of your experience with KwikResume.io.

Consequences of Prohibited Activity

When we detect or confirm any of the above activities, we reserve the right to:

1. Immediately suspend or permanently terminate your account without prior notice.
2. Revoke all credits earned through fraudulent activity prior to the date of detection.
3. Revoke credits from any accounts that benefited from the fraudulent referrals, including accounts that were referred using codes generated through abuse.
4. Report fraudulent financial activity to relevant authorities where applicable.
5. Pursue civil or criminal remedies to the fullest extent permitted by law in the jurisdiction of Ontario, Canada.

Persistent Bypass Attempts

If you attempt to circumvent account restrictions by creating new accounts after a ban, using VPN or proxy services, or using different devices while maintaining the same fraudulent pattern, LiFet Media Inc. reserves the right to:

1. Permanently block your IP address or range of IP addresses from accessing KwikResume.io.
2. Block email domains associated with repeat abuse.
3. Take legal action for damages caused by the fraudulent activity.
4. Report the activity to internet service providers, payment processors, and relevant authorities.

No refunds will be issued for any subscription, credit pack, or lifetime plan associated with an account that is terminated due to fraud or policy violations.

KwikResume.io collects and logs your IP address each time you access, log in to, or create an account on our platform. We collect this information for the following legitimate purposes:

1. Fraud Prevention and Platform Integrity: IP address logging allows us to detect and prevent abuse of our platform, including fraudulent referral activity, creation of multiple accounts to circumvent fair use policies, and unauthorized access to user accounts.
2. Account Security: We use IP address data to identify suspicious login activity, such as access attempts from unusual geographic locations, which helps us protect your account from unauthorized use.
3. Legal Compliance and Audit Trail: Maintaining records of IP addresses associated with account activity is required to comply with applicable laws including Canada's Anti-Spam Legislation (CASL), the General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA). These records form part of our legal audit trail.
4. Service Delivery: IP addresses help us determine your approximate geographic region, which allows us to provide location-appropriate resume formats, language defaults, and regional hiring standards.

We do not sell your IP address data to third parties. IP address records are retained for a minimum of 12 months and a maximum of 36 months, after which they are permanently deleted unless required to be retained longer by applicable law. You may request a copy of your IP address records by contacting hello@kwikresume.io.

Credits on KwikResume.io are a virtual currency used to access AI-powered features within the platform. The following terms apply to all credits regardless of how they were obtained:

1. Credits have no cash value and cannot be exchanged for money under any circumstances.
2. Credits are non-transferable and are tied to the account to which they were issued.
3. Credits earned through subscriptions are issued on a monthly basis and do not roll over to the following month.
4. Credits purchased through one-time credit packs do not expire as long as your account remains active.
5. Lifetime plan credits are issued as a one-time allocation and are replenished according to the terms of the lifetime plan at the time of purchase.
6. Credits granted through referrals, social sharing, video testimonials, or admin adjustments are subject to the same non-transferability and no-cash-value terms.
7. All credits associated with an account are forfeited upon account deletion or termination for any reason including policy violations.
8. LiFet Media Inc. reserves the right to adjust credit pricing, credit costs per feature, and credit grant amounts at any time with reasonable notice provided through the platform.

By creating an account on KwikResume.io and providing your email address and phone number, you consent to receive the following types of communications from LiFet Media Inc.:

Transactional emails and SMS

1. You consent to receive transactional communications necessary to operate your account including payment confirmations, account security messages, and feature-related notifications.
2. These communications cannot be opted out of while your account is active as they are necessary for the provision of the service.

Job follow-up reminder communications

1. When you mark a job application as Applied in your Job Tracker, you consent to receive automated reminder emails and SMS messages at 3 days, 7 days, and 14 days following that action.
2. These reminders will stop automatically if you mark the job as Hired, delete the job, or change its status out of Applied.
3. You may also stop these reminders at any time by contacting hello@kwikresume.io.

Marketing communications

1. You consent to receive marketing emails including product updates, career tips, and promotional offers.
2. You may opt out of marketing communications at any time by clicking the unsubscribe link in any marketing email.
3. Opting out of marketing communications does not affect transactional or follow-up reminder communications.

SMS consent

1. By providing your phone number you consent to receive SMS messages from KwikResume.io.
2. Message and data rates may apply depending on your carrier and plan.
3. You may opt out of SMS at any time by replying STOP to any message we send.
4. For help, reply HELP to any message.
5. We will never sell your phone number to third parties.

CAN-SPAM and CASL compliance

1. All marketing emails include our physical mailing address: LiFet Media Inc., 327 Guy Street, Cornwall, Ontario, Canada.
2. All marketing emails include a clear and functional unsubscribe mechanism.
3. We obtain implied or express consent before sending commercial electronic messages as required under Canada's Anti-Spam Legislation (CASL).
4. Subject lines in all emails are honest and not misleading.

KwikResume.io uses artificial intelligence in the following ways:

1. Resume generation: Your personal and professional information is processed by Anthropic's Claude AI model to generate resume content tailored to your target country and industry.
2. Cover letter and email generation: Your job application details are processed by Claude AI to generate professional documents.
3. ATS analysis and suggestions: Your resume content and job descriptions are analyzed by Claude AI to generate compatibility scores and improvement suggestions.
4. Voice transcription: Audio recordings made in the Voice Builder feature are transcribed using OpenAI's Whisper model.
5. Follow-up email generation: Your job application details are used by Claude AI to generate personalized follow-up emails.

By using KwikResume.io you acknowledge and consent to your data being processed by these AI systems as described. AI-generated content is provided as a starting point and you are solely responsible for reviewing, editing, and verifying any content before submitting it to employers or other third parties. LiFet Media Inc. makes no guarantees about the accuracy, completeness, or effectiveness of AI-generated content for any specific purpose.

1. If you have any questions, concerns, or disputes regarding these Terms of Service, please contact our legal and support team. Note that we do not provide telephone support to ensure all communications are documented accurately. All inquiries must be directed to our official support channel:

1. KwikResume.io may identify resumes that achieve an ATS compatibility score of 80% or higher through our platform's analysis tools.
2. By using KwikResume.io and consenting to these Terms of Service, you grant LiFet Media Inc. the right to share your resume with third-party recruitment agencies, placement firms, and hiring partners for the purpose of identifying potential employment opportunities on your behalf.
3. This sharing is subject to these conditions:
   1. We only share resumes that have achieved an ATS score of 80% or higher.
   2. We do not guarantee that sharing your resume will result in any employment opportunity, interview, or contact from any agency or employer.
   3. We do not guarantee any specific outcome, placement, or compensation resulting from any referral or introduction made through this program.
   4. Agencies and partners who receive your resume are independent third parties. LiFet Media Inc. is not responsible for their actions, decisions, or communications.
   5. We will share only the information contained in your resume and the contact information associated with your KwikResume.io account.
4. You may opt out of resume sharing at any time by contacting hello@kwikresume.io with the subject line "Opt Out — Resume Sharing". We will process opt-out requests within 5 business days. Resumes already shared prior to your opt-out cannot be recalled.
5. This program does not constitute an employment agency relationship. LiFet Media Inc. is a technology platform, not a recruiter or staffing agency.
